Xebra Brands Ltd. has announced that it is one step closer to growing low-THC cannabis in Mexico following a decision from Mexico’s Federal Circuit Court, making it one of the first movers in Mexico’s CBD and CBG market.
In December 2021, all five of Mexico’s Supreme Court justices voted unanimously in favour of granting Xebra’s wholly owned Mexican subsidiary, Desart MX, SA de CV (Xebra Mexico), an irrevocable cannabis injunction.
Following this decision, in March 2022, Xebra announced that the Supreme Court issued and recorded the official final written resolution and directed the Federal Circuit Court to enforce its decision.

The Federal Circuit Court has now enforced the Supreme Court decision, by also recording a written resolution, and by issuing a further irrevocable injunction in favour of Xebra Mexico.
As a result of the granting of the injunction, Xebra Mexico is the only company in Mexico that will be authorised to legally carry-out the importation of cannabis seeds, the cultivation of cannabis, the processing of cannabis, extraction of cannabinoids, and the manufacture cannabis products.

Xebra CEO, Jay Garnett, commented: “We are thrilled that there are no more legal hurdles to overcome.
“The final step in the process is for the Mexican Health Regulatory Agency (COFEPRIS) to grant Xebra Mexico all cannabis authorisations per our Amparo, and we expect that to happen soon.”
Xebra Mexico’s injunction applies specifically to cannabis with low-levels of THC (under 1 per cent), enabling the company to manufacture and sell CBD products, such as tinctures, oils, topicals, edibles, beverages, concentrates, distillates, emulsions, biomass and certain uses of the cannabis flower.
The company is aiming to begin its commercial cannabis activities in Mexico later this year.
