Both out-of-state visitors and visitors from Canada will now be able to purchase medical cannabis in New Hampshire.
New Hampshire’s Alternative Treatment Centers (ATCs) will now be able to dispense medical cannabis to visitors given they hold valid certifications to receive medical cannabis in their respective states or provinces.
The Department of Health and Human Services (DHHS), Division of Public Health Services (DPHS) made the announcement that the provision would come into effect on June 28, 2023.
New Hampshire’s Therapeutic Cannabis Program was established in 2013, and, while many other states have similar programs it is currently illegal to cross state lines while in posession of cannabis due to its federally illegality.

The DHHS has stated that this change to New Hampshire state law will allow visiting patients to avoid the risk of violating federal law by illegally transporting therapeutic cannabis across state lines.
DHHS Director Tricia Tilley stated: “People from other states with severe medical conditions who use therapeutic cannabis to alleviate their symptoms are welcome to travel to New Hampshire with the certainty that they will be able to safely access therapeutic cannabis while they visit our state.”
Visitors will be able to make purchases in the state up to three times per year, however, if the out-of-state patient has a documented qualifying medical condition that is on the list of conditions approved by New Hampshire, those visiting patients may purchase cannabis at New Hampshire ATCs at the same frequency as New Hampshire qualifying patients.
Under the new law, there is a possession limit of two ounces per patient, and all patients are limited to purchasing two ounces of cannabis in any 10-day period.
