    Maryland Judge Halts Ban on CBD Shops Selling Intoxicating Hemp Products

    A Maryland judge has suspended the enforcement of a controversial portion of the state’s recently enacted adult-use cannabis law which banned CBD shops from selling any products with intoxicating levels of THC derived from hemp.

    On July 01 this year, Maryland became the 21st US state to legalise adult-use cannabis, as officials rolled out a scheme which enabled existing medical cannabis businesses to convert their licences and begin selling to the commercial market, with new businesses able to enter the industry next year.

    As part of this new law, any hemp derived products with intoxicating levels of THC, including products like Delta 8, were reserved for sale only by the newly converted medical cannabis businesses.

    According to the Maryland Hemp Coalition, which brought the lawsuit, this stipulation has severely impacted many businesses across the state, and allegedly violates the state’s equal protection and anti-monopoly laws.

    While the legal challenge remains unresolved, with the local government still hoping they can dismiss the lawsuit, the injunction will enable hemp and CBD retailers to begin reselling these products temporarily.

    Director of the Maryland Cannabis Administration, William Tilburg, said in a statement: “The Administration was disappointed to learn of the preliminary decision in Washington County Circuit Court allowing for the continued sale of unregulated, untested, and intoxicating hemp-derived products.”
