    Missouri’s Cannabis Regulator Revokes License of Company at the Centre of Major Product Recall

    Missouri’s Division of Cannabis Regulation (DCR) is set to revoke the license of Robertsville-based Delta Extraction, whose products were at the heart of the state’s recent recall of tens of thousands of cannabis products.

    The ongoing legal battle over some 45,000 cannabis products in Missouri took a decisive turn last week, as the DCR announced plans to revoke the retailers manufacturing license on December 02, 2023.

    Delta Extraction has been accused of using untested cannabis ‘or converted hemp from outside of a Missouri licensed cultivation facility’, which was then used to create thousands of products sold by dozens of retailers across the state.

    The regulators recalled these products in August, and retailers are thought to have lost millions of dollars in sales while the products have been sitting in storage, unable to be sold.

    According to The Missouri Independent, an Administrative Hearing Commission is set for December, in which the fate of these products will be decided, and Delta Extraction will appeal the revocation of its license.

    The cannabis manufacturer has denied accusations that the cannabis used to create these products was illegally imported into the state, arguing that the product it had imported was THC-A, a non-psychoactive hemp product which it later converted into Delta-9 THC (the psychoactive component of cannabis), at its facility in the state.

    Delta Extractions attorney Chuck Hatfield told The Missouri Independent: “The department’s actions are illegal and unfounded. The issue stems from Delta using legal hemp products in its legal marijuana products, which passed state testing before it was sold to consumers.”

    It also argued that Missouri didn’t specifically state that the use of hemp-derived products was banned until its license was suspended in August.

    The DCR have also highlighted ‘numerous other violations of the rules at the facility’, including failing to properly maintain video surveillance footage or have the necessary measures in place to prevent intrusion at the facility.
